Steven R. Kursh, Ph.D., CSDP, CLP has served as an expert witness in several patent matters. He has worked on behalf of plaintiffs and defendants. Recently, Dr. Kursh was retained to submit a Post Grant Review to the USPTO on behalf of the defendants. He has also submitted expert reports, been deposed, and has testified in several patent cases, including cases in EDTX, Delaware, New York, and other states.

Our work in patent litigation has included preparation of expert reports, being deposed, testifying, assisting counsel in terms constructions (pre-Markman hearings), discovery, and preparation for depositions of fact witnesses and experts retained by opposing counsel.

A selected listing of representative engagements in patent litigation includes:

  • Serving as an expert on behalf of the defendant, a software and e-commerce company that provides fraud detection services. Our work included preparation of a non-infringement report and a rebuttal report, being deposed, and testifying at trial.
  • Serving as an expert on behalf of the plaintiff, a software company that developed technologies related to internet filtering. Our work included preparation of an infringement report, the validity report, and multiple rebuttal reports; being deposed; and testifying at trial.
  • Serving as an expert on behalf of the defendant, one of the world's largest financial institutions, in a case relating to consumer financial services and back-office processing systems. Our work included preparation of an invalidity report, non-infringement report, and rebuttal reports. Dr. Kursh was also deposed.
  • Serving as an expert on behalf of the plaintiff, a publicly-traded company, in a case relating to e-commerce marketing and processing of consumer financial services. Our work included preparation of the infringement and validity reports, the rebuttal reports, and being deposed.
  • Serving as an expert on behalf of the defendant, one of the world's largest telecommunications companies, in a case relating to back-office processing systems and related technologies. Our work included preparation of the invalidity and non-infringement reports, the rebuttal reports, and being deposed.
  • Serving as an expert on behalf of the plaintiff, a company that developed technologies related to mobile phone applications. Our work included preparation of the validity report, a rebuttal report, and being deposed.
  • Serving as an expert on behalf of the defendants, two international financial services companies, in a case relating to back-office processing systems and related technologies. Our work included preparation of the non-infringement reports.
  • Serving as an expert on behalf of the plaintiff, a software and e-commerce company focused on the financial services industry. Our work included preparation of a validity report, a rebuttal report, being deposed, and testifying at trial.
  • Serving as an expert on behalf of the defendant, one of the world's largest automobile manufacturers, in a case relating to e-commerce and retail systems. Our work included preparation of an invalidity report, a rebuttal report, being deposed, and testifying at trial.
