Reasonable Measures in a Hybrid-Work World

Notes from the FieldSteven R. KurshSteven R. KurshMarch 10, 20261 minute

The "reasonable measures" test for trade secrets assumed a perimeter: badge in, work on managed machines, leave the secrets behind. Hybrid work erased it. Engineers connect from home networks, personal devices touch corporate systems, and collaboration tools scatter sensitive material across a dozen SaaS products.

A program last revised in 2018 may no longer match how its own people work. What we look for in the field is alignment between policy and practice — and evidence the measures were actually enforced, not merely adopted. Treat it as a living control set and re-tune it as the work keeps moving.
